The update concerns the information that can be transmitted, on a case-by-case basis, via the service eGov-KYC of the Secretariat-General of Information Systems
These terms determine the terms according to which the users – natural persons (hereinafter User/Users) of the application “payzy” application (hereinafter ‘Application’) can proceed to authentication – verification of the data required for the acquisition of a COSMOTE Payments E-Wallet Payment Account, according to those set out in the Framework Service Agreement – Terms of Use of COSMOTE Payments E-Wallet (hereinafter Framework Agreement), through interconnection with the service eGov-KYC of the Secretariat-General of Information Systems.
A. General terms of the Service provision
1. Authentication/update shall be conducted through the Single Digital Portal of the Public Administration (www.gov.gr) and specifically of the service KYC – Know Your Customer of the Secretariat-General of the Public Administration Information Systems of the Ministry of Digital Governance (hereinafter eGov-KYC), in which the User shall login with their personal TAXISnet codes, shall be authenticated and subsequently shall transfer to COSMOTE Payments their personal data for the first time or shall update the existing ones, in case they have already been authenticated through the Application.
The transferred data shall be archived and held by COSMOTE Payments electronically, in the form they are received, exclusively for the purposes mentioned in these terms, that is, the authentication and/or update of the User’s data in the framework of the provisions of the respective legislation on electronic authentication of persons and on prevention and combating of money laundering and terrorism.
2. The data transferred through eGov-KYC are the following:
(a) full name and father’s name, (b) identity card number, (c) issuing authority and time of issue of national identity card, (d) date and place of birth, (e) contact phone number, (f) profession and current professional address, (g) Tax Identification Number (TIN), (h) the size and sources of assets and income of the natural person, as determined in the recent administrative income tax assessment, in cases where this is required in accordance with the policies and procedures of COSMOTE Payments, within the framework of its compliance with the applicable legislation on the prevention and suppression of money laundering and terrorist financing (‘AML/CFT’) and (i) residence address.
COSMOTE Payments may also request additional data, if this is required for reasons of stronger authentication and/or in the context of its compliance with the respective legislation.
3. The User must carefully read this text and accept it, only if they agree with it in its entirety. The authentication/update through eGov-KYC, presupposes the acceptance by the User of the entirety of these terms and conditions, as their non-acceptance makes the provision of data impossible. Furthermore, the use of the Service also entails the acceptance by the User of the Framework Agreement, as well as of the Terms and Conditions of Use of the Application.
4. The Service shall be governed by the provisions of Law 4557/2018, as in force from time to time, and by Article thirty-nine of the Order dated 13.4.2020 “Measures for addressing the continued consequences of the pandemic of coronavirus COVID-19” (GG A’ 84), as ratified by Article 1 of Law 4690/2020 (GG A’ 104) and decision under number 9747 ΕΞ 2021/2.4.2021 of the Minister of State “Electronic handling of due diligence measures through the application eGov-KYC” (GG B’ 1357).
Β. Obligations/Liability of Parties
1. The User: shall be obliged to use the Service exclusively for the purpose it is provided according to the respective instructions and terms of use thereof and, in addition, they recognize that:
— It is strictly forbidden to use the Service for malicious and illegal purposes or in a harmful manner for COSMOTE Payments and/or any third party, or to proceed to any act of malicious use of software and electronic systems of the Service, or to attempt an unauthorized access to a system or subsystem of the software, or to proceed to an act of authentication – login to the Service without authorized use of access data.
— It is forbidden to use the Service for commercial reasons and/or breach in any way the intellectual property rights of COSMOTE Payments, without its previous explicit consent. The Service shall be provided strictly for private use.
— They shall be exclusively liable for the correctness of the data transferred by them to COSMOTE Payments, and they recognise that COSMOTE Payments shall bear no liability regarding cases of incorrect transfer of data from them.
— They grant COSMOTE Payments the right to further transfer the transferred data to third parties (banks, electronic money institutions, etc.) with the purpose of interbank authentication thereof.
— They shall be exclusively liable for keeping secret their personal TAXISnet codes and the special security credentials of the Application. COSMOTE Payments shall bear no liability towards the User for the leakage and use of TAXISnet codes and the Application from third unauthorized persons and shall bear no liability regarding any damage suffered by the User from the above leakage and use of codes by third unauthorized persons.
2. COSMOTE Payments:
— shall, in no case, store and process the TAXISnet codes of the User.
— shall be obliged to keep confidential the data of the User and all received information, to use them only for the fulfilment of the purpose indicated in these terms and in the applicable legislation, and to disclose them only to the necessary employees and only to the extent that this is necessary for the provision of the Service.
— reserves the right to proceed to the upgrade and maintenance of the Service with the purpose of providing better services to the User. During the execution of these operations, COSMOTE Payments shall not bear any liability for any inability of the User to access and use the Service.
— shall inform the User of any appropriate software update in their electronic device, which is required for the operation of the Service.
— shall bear no liability in case of dysfunction or interruption of electronic communication of the User with COSMOTE Payments in the context of the Service, which is due to deficiencies or dysfunction of the online interconnection digital equipment of the User or deficiencies or dysfunction of their mobile phone device. COSMOTE Payments shall not be liable in case any interruption of operation of the Service occurs, which may be due, indicatively and not restrictively, to failure of the network, delay of the telecommunications network, incorrect entrance of codes by the User, dysfunction of the User’s electronic device, dysfunction or failure of its systems or of the systems of the online connection and/or mobile phone provider of the User or any other incident that may constitute a force majeure reason.
COSMOTE Payments also reserves, at its absolute discretion, the right:
— To suspend, in whole or in part, the Service in case problems are detected regarding the functionality of its systems.
— To modify or interrupt temporarily or permanently the operation of the Service when this is necessary for security reasons or for reasons of maintenance or upgrade of the Service or for any other appropriate reason at its discretion.
— To suspend the provision of the Service in case of reasonable suspicions of non-compliance of the User, in whole or in part, with their obligations arising from this document.
— To suspend or interrupt, without penalty and for any reason, the provision of the Service, without previous written notification of the User being required.
C. Other terms:
1. Processing of Personal Data: For the purposes of operation of the Service, COSMOTE Payments, as Controller, shall proceed to the collection, storage, and processing of personal data of the User, in accordance with the applicable European and national legislative and regulatory framework from time to time. The User has been informed by COSMOTE Payments in a clear and intelligible manner on the processing of their data, the recipients of the data, as well as the rights granted to them by the applicable institutional framework, while at the same time they undertake the obligation to timely inform COSMOTE Payments of any change in their personal data. Relevant information on the Processing of Personal Data is posted on its website (https://cosmotepayments.gr/data-privacy.html) and the User is requested to read its content, before accepting these terms.
2. Contact: The User can contact COSMOTE Payments regarding the provision of the Service by the means indicated in the section “Help and Support” and “Contact” in the Terms and Conditions of Use of the Application.
3. Amendment: COSMOTE Payments shall be entitled to amend these terms at any time, without notice, however it shall be obliged to update this text for any amendment or addition.
4. Partial invalidity: In case that any of these terms is found invalid, then such invalidity shall apply only to this term and shall not entrain all of them.
5. Governing Law and Jurisdiction: These terms and any amendment thereto shall be governed by Greek law. Any dispute between the User and COSMOTE Payments deriving from the use of the Service shall be resolved by the competent Courts in accordance with the Code of Civil Procedure.
